By booking and using the landscaping services provided, you agree to abide by the terms and conditions outlined herein. These terms constitute a legally binding agreement between you (the “Client”) and the landscaping service provider.
Satisfaction Guarantee:
We are committed to delivering high-quality landscaping services. If you are not satisfied with the work completed, we offer a satisfaction guarantee. Under this guarantee, you may request that our team return to address any concerns related to the completed service.
To qualify for this guarantee, you must contact us within 24 hours of the service completion. We will make every reasonable effort to resolve your concerns and correct any workmanship-related issues at no additional cost.
Scheduling:
Clients may schedule landscaping services through our website, by phone, or in person. All appointments are subject to availability and weather conditions.
Property Access:
Clients must provide safe and unobstructed access to the property at the scheduled service time. If access is unavailable or restricted upon arrival, a cancellation or service fee may apply.
Scope of Service:
The scope of landscaping services will be based on the selected service package or customized proposal agreed upon during booking. Services may include lawn care, landscape maintenance, planting, mulching, trimming, irrigation adjustments, seasonal cleanups, or other agreed-upon landscaping work.
Materials and Equipments:
Unless otherwise agreed, we will provide all necessary tools and equipment required to complete the service. If plants, mulch, soil, stone, or other landscaping materials are required, these will be supplied as outlined in the service agreement or estimate. Clients with specific material preferences should notify us prior to the scheduled service.
Rates:
Landscaping service rates are based on the size of the property, scope of work, site conditions, and materials required. Pricing is subject to change without prior notice.
Payment:
Payment is due on the day of service unless otherwise agreed upon in writing.
Late Payments:
A late fee may be applied to payments not received within 2 days of the service date.
Client Cancellations:
Cancellations made within 24 hours of the scheduled service may be subject to a cancellation fee.
Rescheduling:
Clients may request to reschedule services with reasonable advance notice. Rescheduled appointments are subject to availability and weather conditions.
Property Damage:
While every effort is made to perform services carefully and professionally, the landscaping service provider is not responsible for damage resulting from pre-existing property conditions, hidden utilities, underground irrigation lines that were not disclosed, improper installations, normal wear and tear, or factors beyond our control.
Health and Safety:
Clients are responsible for ensuring that the work area is safe and accessible. Please notify us in advance of any hazards, underground utilities, pets, security systems, or other conditions that could affect the safe completion of services.
Independent Contractor Status:
Please be advised that our company operates as a referral agency. All landscapers referred by us are independent contractors and not employees of our company. As such, they are solely responsible for the manner and quality of the services provided, including compliance with all applicable laws, regulations, and industry standards. Our company does not assume liability for any aspect of the landscaping services performed or for any actions or omissions of the independent contractors.
Limitation of Liability:
By using our services, you acknowledge and agree that our company is not liable for any disputes, claims, losses, injuries, or damages arising from or related to the conduct or performance of the independent landscaping contractors. Any claims regarding the services provided should be directed to the independent contractor responsible for the work.
Client Information:
We respect your privacy and will keep all client information confidential. Personal information will not be sold, shared, or disclosed to third parties except as required to provide the requested services or as required by law.
Termination:
The landscaping service provider reserves the right to refuse or terminate services at any time due to unsafe working conditions, abusive behavior, inaccessible property, severe weather, or any other circumstance that prevents the safe and professional completion of the work.
These Terms & Conditions shall be governed by and construed in accordance with the laws of Texas. Any disputes arising under or relating to this agreement shall be resolved in the courts of competent jurisdiction within Texas.
The landscaping service provider reserves the right to update or modify these Terms & Conditions at any time. Any changes will become effective upon posting or notification. Continued use of our services constitutes acceptance of the revised Terms & Conditions.
